CHANT PRIVACY POLICY

Chant, LLC (“Chant”, “us”, “we”, or “our”) takes your privacy seriously. We operate a platform for Supporters Groups, Clubs, and Leagues (collectively “Groups”) to manage their communities.
This Privacy Policy applies to your access and use of the Chant mobile application, the website located at www.chant.fan, and any related services (collectively, the “Service”).
1. ROLES: CONTROLLER VS. PROCESSOR
It is important to understand our role in handling your data:
- The Supporters Group (Data Controller): The group you join is the Controller of your data. They decide what information to collect from you to manage their membership.
- Chant (Data Processor): We provide the software and hosting services to the Supporters Group. We process your data on their behalf and according to their instructions.
2. TYPES OF DATA COLLECTED
While using our Service, we may ask you to provide certain personally identifiable information (“Personal Data”). This may include:
- Identity Data: Name, Date of Birth (Day/Month), Shirt Size.
- Contact Data: Email address, Phone number, Physical Address.
- Financial Data: Payment handles (e.g., Venmo, PayPal). Note that we do not store credit card numbers; these are processed directly by our payment processors.
- Membership Data: Your history of joining groups, ticket purchases, event check-ins, and giveaway entries.
- Usage Data: Information on how you access the Service, including device type, IP address, and unique device identifiers.
- Group-Specific Data: Information explicitly requested by a Supporters Group via custom form fields (e.g., coaching licenses, favorite player, referee status).
- Sensitive Data: This includes precise geolocation data (when you use check-in features) and personal data from a known child (under 13). We also classify all data from users known to be under 18 as sensitive for the purpose of prohibiting its sale or use in targeted advertising.
3. USE OF DATA
We use the collected information for various purposes:
- To provide and maintain our Service for your Supporters Group;
- To facilitate your purchases of tickets, merchandise, and memberships;
- To allow you to participate in interactive features (Chat, Polls, Galleries);
- To provide customer support;
- To detect, prevent, and address technical issues and fraud;
- To provide content moderation and enforce our community standards, including through the use of automated scanning tools to detect objectionable material.
Your Right to Limit Sensitive Data
Under laws like the California Privacy Rights Act (CPRA), you have the right to limit the use of your Sensitive Personal Information (such as precise geolocation) to only what is necessary to provide the services you requested.
At Chant, this limitation is our default standard. We collect and use your Sensitive Personal Information only when strictly necessary to provide the specific features you request (e.g., using your location for Event Check-In). We do not use this data for inferring characteristics about you, for marketing, or for any other secondary purpose. Because we already limit our use of your data to these necessary purposes, you do not need to take any action to exercise this right—it is automatically applied to your account.
4. HOW WE SHARE YOUR INFORMATION
We do not sell your Personal Data. We share your information only in the specific categories described below.
A. The Supporters Group (Data Controller)
This is the core function of the App. We share your Member Profile (Name, Email, Ticket History, Membership Status) with the Admins of the specific Supporters Groups you choose to join. They use this data to manage the club, verify your membership, and communicate with you.
B. Service Providers (Processors)
We employ third-party companies to facilitate our Service. They have access to your data only to perform specific tasks on our behalf:
- Infrastructure: Google Cloud Platform, Firebase (Hosting, Database).
- Payment Processing: Stripe, Inc. (Payments, Fraud Detection).
- Performance Monitoring: Elastic / Kibana (Error Logging).
C. Sponsors and Partners (Aggregated Data Only)
We may share non-personal, aggregated, or de-identified data about usage and traffic with our sponsors and partners for general reporting purposes (e.g., “5,000 users checked into an event”). This data cannot be used to identify you individually. We do not allow third-party sponsors to place tracking pixels or cookies on our Service for behavioral profiling.
D. Official Partners & Affiliate Organizations (The Connection Dashboard)
The App allows your Supporters Group to “connect” with external organizations such as professional Clubs, Leagues, local Pubs, or Media Companies (“Official Partners”). If such a connection is established, you may be invited to share your profile data (Name and Email) with that specific Official Partner to unlock benefits, rewards, or exclusive content.
Chant will only share your personal data with an Official Partner if you affirmatively opt-in to that specific connection within the App. Once you opt-in, the Official Partner becomes an independent Data Controller of that information and will handle your data according to their own privacy policy.
E. Legal Requirements
We may disclose your Personal Data if required to do so by law or in response to valid requests by public authorities (e.g., a court or a government agency).
F. Business Transfers
If Chant is involved in a merger, acquisition, or asset sale, your Personal Data may be transferred as a business asset. We will provide notice before your Personal Data is transferred and becomes subject to a different Privacy Policy.

5. DATA RETENTION AND DELETION
We generally retain your Personal Data only as long as necessary to fulfill the purposes outlined in this Policy. However, specific retention protocols apply:
- Account Deletion: If you request deletion of your account, we will delete your authentication records, profile details, and association with Groups. Note: Requesting to delete your account is distinct from leaving a specific group. Leaving a group removes you from that roster but keeps your Chant account active.
- Transaction History: We do not delete financial transaction history (e.g., purchases of member packages, tickets, or donations). This data is retained for financial reporting, tax, and fraud prevention purposes, even after your account is closed.
- Obfuscated Data: Certain contributions you made to the Service (such as chat posts, leaderboard entries, or ticket check-in lists) may remain on the platform. We scrub your personal identifiers (Name, Photo) from public view, effectively de-identifying your presence to other users. However, backend records (such as transaction history) and unstructured content (such as text in chat logs) may remain technically pseudonymized to ensure platform integrity and financial compliance.
6. TRACKING AND ANALYTICS
We utilize technologies to analyze how the Service is used and to maintain its security.
- App Analytics: We use Google Cloud Platform (GCP), Firebase, and Elastic/Kibana to collect “Service Data” (such as IP addresses, device identifiers, and error logs). This data helps us analyze general app usage, prevent crashes, and detect abuse.
- Purpose: These analytics are strictly necessary for:
Performance Monitoring: Identifying bugs and improving app speed.
Security: Detecting fraudulent login attempts and platform abuse. - No Behavioral Profiling: We do not currently implement individual behavioral event tracking for third-party commercial profiling or cross-context behavioral advertising aka targeted advertising.
7. COOKIE NOTICE
We use cookies and similar tracking technologies to track the activity on our Service and store certain information.
Types of Cookies We Use:
- Session Cookies (Essential): We use these to operate our Service. They keep you logged in as you navigate between pages. You cannot opt-out of these as the Service will not function without them.
- Security Cookies (Essential): We use these for security purposes, such as preventing fraud and unauthorized access.
- Preference Cookies (Functional): We use these to remember your preferences and various settings (e.g., language or last group visited).
- Analytics Cookies (Optional): We use these to understand how visitors interact with our website.
Your Choices:
You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent. However, if you do not accept essential Session and Security Cookies, you may not be able to use some portions of our Service (such as logging in or making payments).

If you wish to opt-out of interest-based advertising or analytics cookies generally from other sites, you may use the following industry resources:

8. INTERNATIONAL DATA TRANSFERS
A. EEA, UK, and Switzerland
If you are visiting from the European Economic Area (EEA), United Kingdom (UK), or Switzerland, please be aware that your data will be transferred to and processed in the United States. Chant complies with the General Data Protection Regulation (GDPR).
- Legal Basis for Processing: We process your data based on contract performance (to provide the App services), legitimate interests (fraud prevention), and consent.
- Transfers: For transfers to the US, we rely on Standard Contractual Clauses (SCCs) and a Data Processing Agreement (DPA) entered into with the Supporters Groups.
- Contacting the Controller: For Member Data (your profile within a specific group), the Supporters Group is the Data Controller. Please contact your Group Admin directly for data deletion or access requests.
B. Canada
If you are a resident of Canada, please be aware that your Personal Data may be transferred to, stored, and processed in the United States and other countries where our service providers (Google, Stripe) maintain facilities. While in another jurisdiction, your data may be subject to the laws of that jurisdiction, including laws that may require disclosure of your data to government authorities. By using the Service, you consent to this transfer.
9. TEEN AND YOUTH PRIVACY (AGES 13–17)
Under 13 is prohibited: The Service is not directed to, and we do not knowingly collect Personal Data from, children under 13.
For Users Aged 13-17 (Florida, California, Connecticut, Virginia, UK):
While Chant is rated 17+ and intended for a mature audience, we provide the following protections for users aged 13-16 who access the app with parental consent. We recognize the need for and employ enhanced privacy protection measures for teenage users.
- Technical Service Data Collection: Solely as strictly necessary for the security, performance monitoring, and debugging of the App, as described in Section 6, we do collect technical service data (such as IP addresses, device identifiers, and error logs) from all users, including youth.
- No Behavioral Profiling or Targeted Advertising: We do not use any “Digital Service Data” collected from users known to be under 18 for the purpose of “Targeted Advertising” or “Profiling” as defined by the Texas Data Privacy and Security Act (SCOPE Act) or the Florida Digital Bill of Rights. We do not use this technical data to build behavioral profiles or for any marketing purpose.
- Strict Necessity Standard: We only collect Personal Data from users known to be aged 13-17 when it is strictly necessary to provide the specific services requested, such as participation in a youth league, team roster management, or verifying eligibility for age-restricted events.
- Data Minimization: We limit the collection of youth data to the minimum fields required for operation, specifically: Name, Date of Birth (Month/Day), and Shirt Size.
- Geolocation Guardrails: For all users (regardless of age), geolocation data collection is disabled by default and is only activated when you affirmatively use a feature that requires it (e.g., Check-In). For users known to be under 18, Precise Geolocation is strictly limited to the duration of the “Check-In” event and is not stored or shared as a continuous stream of data.
- Commercial Protections: For all users (regardless of age), we do not use personal data for any commercial purpose other than providing the Service (e.g., we do not license member lists to third parties).
Parental Rights: If you are a parent or guardian and believe your teenager has provided us with Personal Data without your consent, please contact us to request deletion.
10. US STATE PRIVACY RIGHTS (CALIFORNIA, VIRGINIA, COLORADO, ETC.)
This section provides additional details for residents of California, Virginia, Colorado, Connecticut, Utah, Florida, Texas, Oregon, Montana, Delaware, Iowa, Indiana, Kentucky, Maryland, Minnesota, Nebraska, New Hampshire, New Jersey, Rhode Island, and Tennessee, and any additional states that during the period of this privacy policy implement similar comprehensive US state privacy laws (“US State Privacy Laws”).
- Service Provider Status: Under all applicable US State Privacy Laws, Chant acts primarily as a “Service Provider” or “Processor” to the Supporters Groups.
- No Sale or Sharing (Not a Data Broker): Chant is not a Data Broker. We have a direct relationship with you. We do not sell your personal data to third parties. We do not share your personal data for cross-context behavioral advertising. Therefore, we do not provide a “Do Not Sell or Share My Personal Information” opt-out link.
- Global Privacy Control (GPC): We do not “sell” personal data or “share” it for cross-context behavioral advertising or targeted advertising (as defined by applicable state laws) and we already limit our use of your data to what is necessary to provide the Service, consistent with the strictest GPC opt-out standards. - Unfair and Deceptive Acts and Practices (UDAP): We are committed to processing your personal data fairly and transparently. We do not knowingly or intend to engage in unfair or deceptive practices such as utilizing dark patterns to manipulate your consent, or processing your data for purposes that are not reasonably necessary to or compatible with the purposes disclosed in this Policy. These commitments apply under both federal law (FTC Act Section 5) and applicable state UDAP laws.
- Your Rights: Depending on your state of residence, you may have the following right.
- Right to Know/Access: To confirm whether we process your data and access a copy of it.
- Right to Delete: To request deletion of your personal data.
- Right to Correct: To correct inaccuracies in your personal data.
- Right to Portability: To obtain a copy of your data in a portable format.
- Right to Opt-Out: To opt-out of targeted advertising, sale of personal data, or profiling. (Note: We do not engage in these activities).
- Sensitive Data: The right to limit the use of your sensitive personal data (including precise geolocation and data from a known child).
- How to Exercise Your Rights: You can exercise these rights directly within the App (see Section 11) or by emailing privacy@chant.fan. As we often act as a Service Provider, we may redirect your request to the specific Supporters Group (the Business) that controls your data.
- Right to Appeal: If we deny your privacy request, you may appeal our decision by contacting us at privacy@chant.fan with the subject line “Privacy Appeal.” If you are not satisfied with the outcome of your appeal, you may contact your state’s Attorney General.
- Virginia Residents: You may contact the Virginia Attorney General at https://www.oag.state.va.us/consumer-protection/index.php/file-a-complaint.
- Colorado Residents: You may contact the Colorado Attorney General at https://coag.gov/file-complaint/.
- Connecticut Residents: You may contact the Connecticut Attorney General at https://portal.ct.gov/AG/Common/Complaint-Form-Landing-page.

11. YOUR RIGHTS AND CHOICES
Regardless of your location, we provide you with the ability to access, correct, delete, and port your data. Below is a summary of your rights and how you can exercise them directly within the App:

Right to Block (User Safety)
In addition to your data rights, you have the right to block any user. When you block a user, we immediately cease sharing your profile presence (Name/Photo) with that user in real-time features like Chat or Member Lists.
Verification: For any requests made via email or support tickets, we reserve the right to verify your identity (e.g., by sending a confirmation code to your email address on file) before processing your request to protect your account security.
12. CHANGES TO THIS PRIVACY POLICY
We may amend this Privacy Policy from time to time. When there are significant changes, we will endeavor to notify users via a prominent notice on the Service or email. The date at the top of this policy indicates when it was last updated.
